Tribunal Nullifies Bayelsa Governorship Election

The Bayelsa State Governorship Election Tribunal has on Monday nullified the election of Governor Douye Diri as it ordered the Independent National Electoral Commission (INEC) to conduct a fresh election within 90 days.

Earlier, the Advanced Nigeria Democratic Party (ANDP) had filed a petition challenging the victory of Governor Diri of Peoples Democratic Party (PDP) in the November 19 governorship election claiming that the ANDP was unlawfully excluded from the ballot papers used for the election.

The party demanded an order for a fresh election on the grounds that its name and logo were excluded from the election.

The three-man panel led by Justice Yunusa Musa ruled that the election was unlawful due to the exclusion of ANDP and its candidate.

In its argument, INEC said that the party’s Deputy Governorship candidate was 34-year-old as at the time of nomination and therefore did not qualify to contest the election.

However, the tribunal responded that INEC has no power to disqualify any candidate and insists that the petition of the ANDP stands adding that only a court has the power to disqualify any candidate for any election and that the petition was filed within 21 days, which is the stipulated time for petitions to be filed.

Moreover, the tribunal ruling can still be challenged at the appeal court.

Diri’s nullification came two days after a three-member panel of the tribunal dismissed three petitions challenging his election as governor.
